The Police judge L. Louwerse has acquitted a 52-year-old Belgian pilot of a bow wave incident on the Western Scheldt. On Aug 30, 2022, the Belgian was a pilot on board the 'MSC Geneva', now sailing as 'Jolly Bianco', which was underway towards the North Sea. According to the Public Prosecution Service, the pilot was sailing at too high a speed, causing a dangerous bow wave. As a result, the inland vessel 'Ludovica' (MMSI: 244690902) was damaged when it was struck. Public Prosecutor M. Nieuwenhuis found the pilot guilty of the incident, not taking sufficient account of the situation and not taking measures to adjust the speed, despite a warning from the Hansweert traffic post and a report from a skipper. The officer determined that the pilot had not acted adequately. ‘The speed was already too high in the bend at Hansweert, causing damage to the 'Ludovica' due to the bow wave, which was not good seamanship.’ The officer demanded a fine of 500 euros. This amount was the settlement proposal. The pilot had objected to this, so the case came before the court. During the hearing, the police judge wondered whether the suspect should have reduced speed as a precaution. The experienced pilot said he had seen no reason to do so. ‘He did not slow down, because there was no shipping in the area. Other ships had already passed. The 'Ludovica' was already next to the waterway, but was not immediately visible. The radar on board was different. The warning from Hansweert did not mention the name of the ship. Counsel M. van der Bent came to the conclusion that there was no concrete reason to reduce speed. The ship was not sailing too fast. The 'Ludovica' was loaded with steel and was apparently sensitive to waves. When it came into view, the container ship slowed down. The lawyer also questioned the condition of the inland vessel. Van der Bent wanted to demonstrate the vulnerability of the 'Ludovica'' by stating that the ship was very deeply loaded, causing the gangway to be flooded. He pleaded for acquittal and pointed out the excellent service record of his client, who has been a river pilot for 15 years. The 'Ludovica' had suffered water damage to the cargo and to a printer. The injured skipper did not file a claim for damages. In his final statement, the pilot indicated that the qualification of ‘bad seamanship’ had been hanging over his head like a dark cloud all this time. The police judge agreed with the defense counsel’s defense that no information was known about the inland vessel, such as its draft. That made him doubt. ‘Other ships did not suffer any damage in that bend. The acquittal was a relief for the pilot, who was supported by colleagues in court. The Russian captain of the 'MSC Geneva' settled by paying a fine of 500 euros.

Kaliningrad
Ukraine's military intelligence directorate, the GUR, has claimed responsibility for a serious fire aboard the Russian corvette 'Serpukhov' at the port of Kaliningrad, a Buyan-M class vessel. GUR provided what appeared to be a schematic of the vessel's internal spaces, and a brief video of an incendiary device going off. The agency said that the 'Serpukhov' sustained substantial damage from the fire, with its means of communication and automation were completely destroyed. The Buyan class is designed for coastal operations and are heavily armed for their size, carrying up to eight Kalibr or Oniks antiship missiles and up to eight surface-to-air missiles. This was a deep strike behind the Russian lines. The agency's drones have hit Russian oil refineries up to 750 miles away from Ukraine's borders, and have taken approximately 14 percent of Russia's refining capacity offline. The latest strike - a claimed attack on a product pipeline - allegedly disabled all product tanker loadings at the occupied port of Azov. The GUR has also mounted a successful campaign against the Russian Black Sea Fleet, damaging or destroying a claimed one-third of its force and confining the rest to the relative safety of Novorossiysk. The sister ship 'Velykyi' Ustyug was likely damaged by a Ukrainian drone early in the Russian invasion. In June 2022 the 'Ustyug' was photographed in tow to a shipyard, showing signs of fragmentation damage along her port side. X-PRESS PEARL
A VDR transcript has emerged with a series of conversations between the master of the 'XPress Pearl' and shoreside managers. The document was filed by Sri Lanka's government in a case before Colombo's Supreme Court; the shipowner disputes the document's accuracy and completeness, and was contesting it in court proceedings. It appeared to confirm initial accounts of a slow-rolling catastrophe that began long before the 'XPress Pearl' reached Sri Lanka in May 2021. It providd new details of the crew's attempts to respond to a leaking container of nitric acid, and Vitaly Tyutkalo. the Russian master's growing frustration with the lack of a solution: "About one liter an hour [leak rate from the container]. Remain the same. We're washing deck continuously by fire pump, seawater, because main deck too much corrosion . . . very strong chemical, very strong chemical If you will read my email, I sent to everybody, right, already three days fire pump running. But leakage remain on deck and maybe more and more corrosion." After the call with the home office, he complained to a crew member on the bridge that "they don't take any action, don't give me any advice," and claimed that company officials wouldn't take responsibility. Port officials at Hamad, Qatar and Hazira, India refused to provide a port-of-refuge service to unload the leaking boxes from the 'Xpress Pearl', so the ship sailed onwards to Colombo, Sri Lanka, a voyage of some 1,000 nautical miles southeast from Hazira. After the arrival off Colombo, a container on deck caught fire, but local authorities refused to allow the 'XPress Pearl' to berth for firefighting operations. The master was facing criminal charges in connection with the disaster and remained in Sri Lanka at least as recently as last year, free to live on the island but unable to leave until court proceedings have finished.
Port au Prince
On April 4, 2024, the containerm/v 'Magalie' ((IMO: 7413892)) was hijacked by members of the 5 Seconds gang in the Varreux terminal neighborhood at Port-au-Prince. The gang members took all crew members hostage and stole one-sixth of the cargo, which included rice, Haiti's main staple food. On April 8, Haiti's National Police stormed the ship and engaged in a five-hour gunfight. The operation resulted in the injury of two officers and an unspecified number of gang members being killed. The vessel was retrieved safely, and Haiti's Port Authority assisted in transporting the onboard personnel. The status of the crew members was unknown. The ship was pulled away from the shore by a tug. Gangs have frequently attacked Port-au-Prince's waterfront operations, causing disruptions to the supply and relief flow. Last month, vandals destroyed the Varreux Power Plant and briefly took over and looted the Caribbean Port Services (CPS), the biggest container terminal in the country. The UN's Famine Early Warning System Network states that the terminal's waterside activities may remain closed for several weeks.
